Terms of Use

These Terms of Use govern your access to the property listing information made available on this website (the “Site”), operated by NestAbode — Stevie Crawford, Broker, of Right at Home Realty, Brokerage (the “Member”). The listing information is provided under licence from the Toronto Regional Real Estate Board (“TRREB”) through its data-syndication platform, PropTx. By creating an account, signing in, or otherwise using the listing information, you agree to these Terms.

Your agreement

By opening, reviewing, and accepting these Terms — a single mouse-click is sufficient to indicate acceptance — you affirmatively agree to each of the following:

  1. You acknowledge that you are entering into a lawful broker–consumer relationship with the Member.
  2. All MLS® data obtained from this Site is intended only for your personal, non-commercial use.
  3. You have a bona fide interest in the purchase, sale, or lease of real estate of the type offered through this Site.
  4. You will not copy, redistribute, retransmit, or otherwise reuse any of the data or listing information provided, except in connection with your own consideration of the purchase, sale, or lease of an individual property.
  5. You acknowledge PropTx’s and TRREB’s ownership of, and the validity of their proprietary rights and copyright in, the MLS® database, MLS® data, the MLS® System, and the listing information.
  6. You will not, directly or indirectly, display, post, disseminate, distribute, publish, broadcast, transfer, sell, or sublicense any listing information to another person or entity. Prohibited uses expressly include “scraping” (including screen-scraping and database-scraping), “data mining,” and any other activity intended to collect, store, reorganize, summarize, or manipulate any listing information or related data.
  7. You understand that your acceptance of these Terms by mouse-click imposes no financial obligation on you and creates no representation or agency agreement between you and the Member.
  8. You authorize PropTx, TRREB, and other PropTx Members and their duly authorized representatives to access this Site for the purposes of verifying compliance with the MLS® Rules and Policies (including the VOW Rules) and monitoring the display of the Member’s listings.
  9. You acknowledge the Site’s Privacy Policy, which describes how personal information that you provide may be collected, used, and disclosed — including that it may be shared with PropTx and TRREB for auditing and/or legal purposes — and you consent to those practices.

Registering for an account

Access to certain listing information is reserved for registered consumers. To register, you must provide your name and a valid email address, which we will verify by sending a confirmation to the address you provide; access is granted only after that email is verified and you have agreed to these Terms. You will choose a username and password that, together, are unique to you. Passwords are valid for up to 90 days, after which they must be renewed or reconfirmed. You are responsible for keeping your credentials confidential and for all activity under your account, and you agree not to share your login with any other person.

For bona fide consumers only. The information provided on this Site must only be used by consumers who have a bona fide interest in the purchase, sale, or lease of real estate of the type being offered, and may not be used for any commercial purpose or any other purpose. The data is deemed reliable but is not guaranteed accurate by PropTx or TRREB.

Accuracy & availability

Listing information is provided “as is.” While it is deemed reliable, it is not guaranteed accurate by PropTx, TRREB, or the Member. Where a seller has directed that a listing or its address not be displayed, that information will not appear on this Site. We may withdraw, suspend, or limit access to the Site or any listing information at any time.

Privacy & your information

We collect and handle your personal information in accordance with our Privacy Policy and Canadian privacy law (PIPEDA). You may request access to, correction of, or removal of your personal information at any time, and we will respond as required by law and the MLS® Rules. Where you ask us to remove your personal information, we will comply and advise PropTx accordingly.

These Terms do not alter the MLS® Rules and Policies, the VOW Rules, or any agreement between the Member and PropTx/TRREB.
